# Terms of service. The rules, briefly.

How plans, billing and credits work, what you can and can't do with the data, and the usual limits on our liability.

## 01 The service

Incumbently gives you technographic data: which companies use which software tools, and when they start or stop. You can use it in the dashboard, through the API, or in AI assistants through our MCP server. By creating an account or using the service, you agree to these terms.

## 02 Your account

Incumbently is for business use. Keep your sign-in, API keys and MCP connections secure: you're responsible for what happens under your account and your workspace.

## 03 Plans and billing

The Free plan costs nothing. Paid plans are billed monthly in advance through Dodo Payments, our merchant of record, which also handles tax and receipts. Current prices are on the [pricing page](https://www.incumbently.com/pricing). We'll email you before a price change applies to your plan.

## 04 Credits

The API is metered in credits: one credit returns one company record, and some calls cost nothing. Each paid plan includes a monthly allowance that resets at the start of each calendar month; unused allowance doesn't roll over. Credits we grant on top of your allowance don't expire. When you run out, API calls that need credits stop until the allowance resets.

## 05 Cancelling

You can cancel at any time in the app, under Settings. Your plan stays active until the end of the period you've paid for, then moves to Free. We don't refund partial periods, except where the law requires it.

## 06 Acceptable use

Use the data inside your business, for research, prospecting, sales and marketing. Don't:

- Resell or redistribute the raw data, or use it to build a competing data product
- Scrape the app or the website, or pull data in bulk beyond your plan
- Go past fair-use limits: MCP answers are capped at about 100 companies each
- Share API keys or accounts outside your workspace
- Use the data to harass people, send unlawful spam or break any law
- Try to break, overload or get around the service's limits or security

We may limit or suspend accounts that break these rules.

## 07 The API and MCP server

API keys and MCP connections belong to your workspace. The API uses credits and the MCP server is unlimited under fair use; rate limits apply to both. We may change or retire endpoints and tools, and we'll give notice before breaking changes where we can.

## 08 About the data

Our data comes from public signals and some of it is inferred, so it can be incomplete, out of date or wrong. Check anything important before you rely on it.

## 09 No warranty

Incumbently is provided as is and as available, without warranties of any kind, to the extent the law allows.

## 10 Liability

To the extent the law allows, we aren't liable for indirect or consequential losses, lost profits or lost data. Our total liability for any claim is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.

## 11 Ending your use

You can stop using Incumbently and ask us to delete your account at any time. We may suspend or close accounts that break these terms or don't pay, with notice where reasonable.

## 12 Changes and contact

We'll update these terms from time to time and email you about changes that matter. Using Incumbently after a change means you accept it. Questions go to [hello@incumbently.com](mailto:hello@incumbently.com). Our [privacy policy](https://www.incumbently.com/privacy) explains how we handle personal data.
